This contract is entered into between Calico Pet Sitting, "The Client" and a "Third Party" (both to be referred to as "client" going forward). By the Client submitting their Name, the Client is confirming that this contract is binding. Client desires to engage Calico Pet Sitting, Ltd., it's employees, members, agents and representatives ("Calico Pet Sitting, Ltd.") to obtain the care and services provided by Calico Pet Sitting, Ltd. (the "services") for client's pet(s) ("the pets"), and Calico Pet Sitting, Ltd. agrees to provide services in accordance with the terms and conditions of this service agreement (the "agreement"). In consideration of the following terms and conditions, the other good and valuable consideration hereby acknowledged by the parties hereto, client and Calico Pet Sitting, Ltd. agree as follows: For the purposes of this document, the terms Client, Owner, Pet Owner, and Customer are synonymous with the person contracting services for one or more domestic animals. *

PET OWNER RIGHTS: As a Client of Calico Pet Sitting, Ltd., you must have the legal right to place pet(s) in the care of Calico Pet Sitting, Ltd and make all executive decisions regarding care. Calico Pet Sitting, Ltd. cannot service a home with "visiting" pets or animals that do not belong to the resident of the service site, unless a separate Client Profile, Pet Profile, Client Service Agreement and Veterinary Release is signed by the visiting pet's owner. If a third party is involved with the care of pet(s) or will be entering the client's home, they must also have the legal right to place pet(s) in the care of Calico Pet Sitting, Ltd and make all executive decisions regarding care. *

THIRD PARTIES: Calico Pet Sitting, Ltd. services, owners, agents, assigns, successors and heirs are not liable and are completely indemnified for any and all liability stemming from act(s) or failure to act of third parties, whether known or unknown, including but not limited to: friends, neighbors, relatives or other service persons that shall enter your residence for any purpose while Calico Pet Sitting, Ltd. is caring for your pet(s). The names, phone numbers and stated purpose of all individuals not affiliated to Calico Pet Sitting, Ltd. that may be entering the home in your absence or may be parking in your driveway while you are away must be given to Calico Pet Sitting, Ltd. beforehand. Any and all unexpected people or vehicles will result in a phone call to the police. *

PET RESPONSIBILITY: You, the Client, and/or the Third Party shall be solely responsible for any and all acts of and behavior of you pet(s) and/or the Client's pet(s) while in the care of Calico Pet Sitting, Ltd. This includes, but is not limited to, damage to Calico Pet Sitting, Ltd. property and injury to other animals or persons caused by my pet(s). Should your pet(s) bite or otherwise injure an agent of Calico Pet Sitting, Ltd., I agree to pay all medical costs and lost wages incurred by the agent due to such injury. *

CLIENT INDEMNIFICATION CLAUSE: In the event of an emergency (e.g., injured pets, severe weather, broken pipes, natural disaster, fire, etc.), Calico Pet Sitting, Ltd. will do everything possible to contact the client and then the emergency contact(s) before making a subjective decision on dealing with the issue. In an emergency situation, Calico Pet Sitting, Ltd. is hereby authorized to take all measures deemed necessary or advisable by Calico Pet Sitting, Ltd. in its sole and absolute discretion in caring for all pet(s) and Client's property (including and without limitation to emergency veterinary care for all pet(s) and emergency repair services for the client's home) and Client agrees to defend, indemnify and hold harmless Calico Pet Sitting, Ltd., its respective employees, members, agents and affiliates from all liabilities, claims and expenses, including reasonable attorney fees, that arise from or relate to such decisions. In the event of such an emergency, Client shall immediately reimburse Calico Pet Sitting, Ltd. for expenses incurred, plus any additional fees or expenses for attending to such an emergency. *

THIRD PARTY INDEMNIFICATION CLAUSE: In the event of an emergency (e.g., injured pets, severe weather, broken pipes, natural disaster, fire, etc.), Calico Pet Sitting, Ltd. will do everything possible to contact the client and then the emergency contact(s) before making a subjective decision on dealing with the issue. In an emergency situation, Calico Pet Sitting, Ltd. is hereby authorized to take all measures deemed necessary or advisable by Calico Pet Sitting, Ltd. in its sole and absolute discretion in caring for all pet(s) and Client's property (including and without limitation to emergency veterinary care for all pet(s) and emergency repair services for the client's home) and the Third Party agrees to defend, indemnify and hold harmless Calico Pet Sitting, Ltd., its respective employees, members, agents and affiliates from all liabilities, claims and expenses, including reasonable attorney fees, that arise from or relate to such decisions. In the event of such an emergency, the Third Party shall immediately reimburse Calico Pet Sitting, Ltd. for expenses incurred, plus any additional fees or expenses for attending to such an emergency. *

THIRD PARTY ASSUMES COMPLETE RESPONSIBILITY: As a third party, I understand that by signing this Waiver and Release, I expressly and willingly agree to assume complete responsibility for any risk of injury, personal property damage, pet loss/theft, or death that may arise with the Client’s pet(s), property, and home. I waive all claims for property damages, injuries to myself, the pet(s) or Calico Pet Sitting, Ltd. agents or employees; diseases, pet loss/theft, and death sustained to the Client’s pet(s) or property, or to an agent or employee of Calico Pet Sitting, Ltd. I understand that the my pet(s) and/or the Client’s pet could be lost or escape, injured during play, or die, while in my care. The Client’s home, property, or personal belongings could be damaged during this time, as well. By this waiver, I assume any risk, and take full responsibility and waive any and all claims of damages to personal property, injuries, diseases, loss/theft, or death pertaining to the Client’s pet(s) and/or myself, including, but not limited to, cuts or puncture wounds, scratches/chewing on personal belongings, walls, or flooring, accidental disease from outside or the petsitter themselves, and loss of pet by escaping through the door or gate, or being stolen from the property. If the Client’s pet or property are harmed while in my care, I will not hold Calico Pet Sitting, Ltd. responsible even if the injuries, damages, illness, loss/theft, or death were cause by negligence on my part or Calico Pet Sitting, Ltd., or any other party under or affiliated with Calico Pet Sitting, Ltd.

This contract shall be interpreted and governed by the laws of The State of Colorado. Each party will perform its obligations in accordance with all the applicable laws, rules, and regulations of The State of Colorado. *

Each waiver or excuse shall be independent of all others. Therefore, if a term or provision is waived or breach is excused, that waiver or excuse shall not waive any other term or provision or excuse any other breach. *
